Summary: Approves the lists of countries to which the rules on air traffic, airports and land, sea and river borders apply and establishes the validity requirements of vaccination or recovery certificates issued by third countries, under reciprocal conditions.

In the context of the epidemiological situation caused by the SARS-CoV-2 virus and the exceptional measures adopted to deal with the disease COVID-19, the Resolution of the Council of Ministers No. 135-A/2021, of September 29, declares the situation warning throughout the continental national territory, providing for the rules applicable to air traffic, airports and land, sea and river borders.

In articles 14 and 18 of the regime attached to the aforementioned resolution of the Council of Ministers, it is established that the members of the Government responsible for the areas of foreign affairs, national defence, internal administration, health and civil aviation may , by order, allow non-essential travel originating in specific countries, including countries, special administrative regions and territorial entities and authorities not recognized as countries by at least one Member State of the European Union, whose epidemiological situation is in accordance with the Recommendation (EU) 2020/912 of the Council, of 30 June 2020, in its current version.

In addition, under the terms of paragraph 2 of article 5 of Decree-Law no. 54-A/2021, of 25 June, the said members of the Government may also, for the purposes set out in section ii of the chapter ii of the aforementioned legal diploma, regarding the use of the EU COVID Digital Certificate in matters of air and maritime traffic, to recognize, by order, the validity of vaccination or recovery certificates issued by third countries, under reciprocal conditions, without prejudice to the travelers holding an EU COVID Digital Certificate or travellers holding a digital certificate that has been the subject of an implementing decision of the European Commission pursuant to Article 8(2) of Regulation (EU) 2021/953 of the European Parliament and of the Council, of 14 June 2021, to be able to carry out non-essential trips, regardless of origin.

Thus, under the combined terms of paragraph 1 of article 18, paragraph 1 of article 19, paragraph 1 of article 27 and article 29 of Decree-Law no. 169-B/2019, of December 3, in its current wording, of paragraph 2 of article 5 of Decree-Law no. 54-A/2021, of June 25, and articles 14 and 18 of the regime attached to Council of Ministers Resolution No. 135-A/2021, of 29 September, the Minister of State and Foreign Affairs, the Minister of National Defense, the Minister of Internal Administration, the Minister of Health and the Ministry of Infrastructure and Housing determine:

1 – Allow non-essential travel from Brazil, the United States of America and the United Kingdom.

2 – Approve, in Annex I to this Order, of which it is an integral part, the list of countries, special administrative regions and territorial entities and authorities not recognized as countries by at least one Member State of the European Union, whose epidemiological situation complies with Council Recommendation (EU) 2020/912, of 30 June 2020, and respective updates, whose air traffic to and from mainland Portugal is authorized, for non-essential travel purposes, subject to confirmation of reciprocity.

3 – Recognize, for the purposes set out in section ii of chapter ii of Decree-Law No. 54-A/2021, of 25 June, the validity of vaccination or recovery certificates issued by third countries, under reciprocal conditions, when these form part of the data fields listed in Annex II to this Order, of which it forms an integral part.

4 – Non-reciprocity in the recognition by third countries of the validity of the EU COVID Digital Certificate, in the modalities of vaccination or recovery certificates, issued by Portugal, prevents recognition of the validity of certificates issued by these third countries.

5 – Without prejudice to the provisions of paragraphs 3 and 4, the validity of vaccination certificates issued within the scope of this Order will only be recognized if their holders have been inoculated with vaccine against COVID-19 with authorization for marketing in the terms of Regulation (EC) No. 726/2004, set out in annex iii to this order, of which it forms an integral part.

6 – This order takes effect from 00:00 on October 1, 2021 and until 23:59 on October 31, 2021, and may be revised at any time, depending on the evolution of the epidemiological situation.

ANNEX II

Mandatory minimum data for recognition of vaccination or recovery certificates referred to in paragraph 3

1 – Vaccination certificates must include at least the following information:

a) Name(s) and surname(s) of the holder;

b) Date of birth;

c) Target disease or agent: COVID-19 (SARS-CoV-2 or one of its variants);

d) COVID-19 vaccine or prophylaxis;

e) Name of the vaccine against COVID-19;

f) Marketing authorization holder or manufacturer of the vaccine against COVID-19;

g) Number in a series of doses, as well as the total number of doses in the series;

h) Date of vaccination, indicating the date of the last dose administered;

i) Member State or third country where the vaccine was administered;

j) Entity issuing the certificate.

2 – Recovery certificates must include at least the following information:

a) Name(s) and surname(s) of the holder;

b) Date of birth;

c) Disease or agent from which the holder recovered: COVID-19 (SARS-CoV-2 or one of its variants);

d) Date of the first positive result of the diagnostic test;

e) Member State or third country in which the diagnostic test was carried out;

f) Entity issuing the certificate;

g) Certificate valid since.
